Snow and Ice Safety – Property Owners Have a Legal Responsibility

Previously, when snow or ice formed a natural accumulation such as the inch or two that falls in between removals, property owners could not be held liable.  The Massachusetts Supreme Judicial Court overruled 125 years of legal precedent, announcing a new law mandating all property owners legally responsible for the removal of snow and ice from their property, even if it is from a natural accumulation.

This means property owners, both residential and commercial, need to be extra vigilant after snow and ice storms to clear areas the public and visitors have access to, early and often.

In the event of a legal claim, a jury will determine on a case-by-case basis whether or not the property owner took reasonable steps to remove snow and ice.  While this ruling is good for public safety, it has the potential to increase the slip and fall cases being filed. Property owners can better protect themselves by obtaining an umbrella policy to provide better coverage for liability losses.
